Since we published our blog post about the upcoming September 9th FDA deadline that will be forcing most vape flavors into retirement, we've received many questions from customers wanting to know more details. In an attempt to answer those questions, we've created this blog post to serve as a live Q&A.
We've answered some of the most common questions we received below. If you have another question, just leave it as a comment and we'll answer it and add it to this post!
Yes, and thank your for asking!
First, please stock up on the flavors that will disappear in September. You'll be able to enjoy your flavors even after the deadline and every cent helps us as we struggle to afford our PMTA. We are putting every last penny that we have into this effort and we've got hundreds of thousands of dollars in lab testing bills alone coming due over the next couple months so every purchase helps!

The expiration date on our bottles is two years after the date of manufacture. Vape juice really doesn't usually go bad in the sense that it starts to smell or taste rancid, unless it is exposed to prolonged, direct sunlight (for example, if you leave it in a hot car over the summer!). However, the nicotine will gradually degrade over time resulting in slowly sinking nicotine levels.
The best way to store e-liquid you are not going to use immediately is in the freezer. The cold temperature will slow down the process of nicotine degradation. It won't stop it completely, but it will buy you extra time!
Sadly, no. We're committed to the 20 candidates for the PMTA and this list will be further reduced to 10 in the next few weeks. Unfortunately, we just can't afford to save more than 10 flavors and we've already had to make some hard choices as well as pony up for the first rounds of lab testing. We wish we could add more flavors but we just can't change course at this point. There were a lot of factors that led to our selection of the 20 candidates and we truly wish we could save more of our flavors!
Unfortunately, no. The FDA saw this sneaky work around coming from a mile away and specifically defined e-juice to include any component that is reasonably expected to be added to vape juice. So, sadly, we won't be able to sell flavors separately after the September 9th deadline.
Yes! If we are successful in our PMTA application, we would be able to bring back additional flavors in the future provided we were able to create PMTA's for them as well. So, this would be conditional upon us surviving the PMTA and recovering financially enough to be able to afford additional PMTA's in the future. We don't foresee this happening until at least a year after the PMTA deadline but it is definitely a possibility in the future!
The ban on flavored vape pods was an interim action by the FDA in response to calls for an immediate, country wide ban on all vape flavors. Fortunately, they decided to only ban flavored vape pods and allow open system e-juice flavors to continue to try to stay in business by going through the PMTA process.
The PMTA stands for Premarket Tobacco Product Application. It is required by the FDA and the deadline was drastically accelerated last year by a court case brought by the American Academy of Pediatrics against the FDA. The PMTA is completely different from the flavored vape pod ban and remains in effect and due on September 9th.
Because of the extremely high cost, few vape companies will be able to afford it and it remains very uncertain whether the FDA will accept the applications of those companies that do try to comply due to the regulatory complexities of the PMTA process and lack of any clear pass/fail guidelines.
We have 20 flavors that are on our list of candidates to submit to the FDA so they can remain available after September 9th.
Please keep in mind that this list will be cut in half in the next few weeks as we can only afford to take 10 flavors through the entire PMTA.
Please understand that we share your sorrow if your favorite flavor is not on this list! We wish we could save all of our wonderful flavors but, sadly, this is far beyond our means and we simply cannot afford it!
